Mongkol Will Trade Compulsory Licensing for Generics

Drug Access | Thailand Will Not Issue Compulsory Licenses for Patented Drugs if Pharmaceutical Companies Match Generic Prices, Health Minister Says


[May 16, 2007] Thai Health Minister Mongkol Na Songkhla on Tuesday said that Thailand will not issue compulsory licenses to produce reduced-cost versions of patented drugs if pharmaceutical companies offer prices lower than those charged by generic drug makers, Reuters AlertNet reports. Mongkol's comments came one day after Abbott Laboratories and Thailand failed to reach an agreement on the price of Abbott's antiretroviral drugs Aluvia and Kaletra (Reuters AlertNet, 5/15).

I actually think the government would be better off going for this strategy instead of making their own drugs. I don't trust the GPO. It is a corrupt institution. It has a history of political interference and overcharging poor people for drugs. And I don't trust it to make the drugs correctly.

I think the most logical argument would be for the purchaser to choose a profit margin that it thinks is fair compensation for the research invested and then stick to its guns on that amount. To me, asking for generics pricing implies that you are only willing to pay for manufacturing and distribution.
